Abstract This paper highlights the domestic waste management problems that South Africa is facing and provides an overview of the current legal regime pertaining to domestic waste management in South Africa. Market based instruments that are relevant in terms of creating incentives for improved domestic waste management are examined. The extent to which market based instruments may be appropriate and useful as a tool within the domestic waste management regulatory regime and the opportunities for South Africa to effectively make use of these instruments are assessed with reference to experiences in other countries.
