Abstract
Trademarks is an important branch of intellectual property law which guarantees rights over goods and services of a manufacturer as against an infringer and other persons. However, before delving into the province of trademarks, it is imperative to consider albeit cursorily what intellectual property is all about in view of the obvious fact that intellectual property law practice is fast gaining primary function of establishing intellectual property legal rights. This importance is aptly seen in the statement of one of the great authors on intellectual property law, viz: . Intellectual property is in demand as never before. Those who undertake scientific and technological research, those who create and interpret works of learning, culture, entertainment and information, those who design the marketing of products and services and look to legal protection against competitors as a way of sustaining the value of their skill and labour or their investment in what is distinctively theirs. In biotechnology, computing, telecommunications, inventions ... the scale of production of new individual materials is such that their case has to be conceded, rights have to be created or enhanced"1. - Faculty of Law, University of jos |
