Abstract
CURRENT JOS LAW JOURNAL - This paper will be divided into five major parts. Initially, we shall explore the legal concessions to women, children and young persons under Nigerian law. Secondly, we shall explore the new innovations in the 1989 condition as far as young persons are concerned. We shall hazard a guess about its efficacy. Thirdly, existing facilities in the penal system for the "treatment" of women, children and young persons shall be explored with the view of ascertaining its efficacy and adequacy. Fourthly, the possible side effects of incarceration on the above group shall be highlighted and lastly recommendations capable of ameliorating the situation shall be made before the conclusions. The "lumping" together of women, children and young persons is not intended to be derogatory. Our aim in the "lumping" is to demonstrate that the above named group belong to the "disempowered" group in the society. Before the advent of colonialism and the consequent imposition of a foreign penal system our various customary he seconded to the above group lighter punishment than was ordinarily imposed on other classes in the society. Its continuation to some extent by, colonial and post-colonial governments was therefore not a new phenomenon all together. |
