Abstract
THE ADVOCATE A JOURNAL OF CONTEMPORARY LEGAL ISSUES - The word justice or the expression "restorative justice" is a nebulous word or concept, which is difficult to define. Indeed justice is a universal concept. It all depends on the angle from which one views it i.e. be it social, political, economic or legal justice, etc. However, the word justice simply connotes a state of being right or fair. Restorative justice in this context is looked at from the legal perspective and as a working guide, can therefore safely be said to be an act of balancing between the offender, the victim and the community or to some extent the society in the realm of criminal justice. It concerns itself with trying as much as possible to restore or put back the victim of a crime to the position or state he was before the commission of the crime. |
